Magic Coils — Terms of Service

1. Agreement to These Terms

These Terms of Service (the "Terms") form a legal agreement between you and Hair For You LLC, doing business as Magic Coils ("Magic Coils," "we," "us," or "our"). By accessing or using magiccoils.net (the "Site"), placing an order, taking the hair quiz, subscribing to our emails, or otherwise interacting with us, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Site.

These Terms are not negotiable. We may update them from time to time — see Section 17.

2. Eligibility

You may use the Site if you are at least 18 years old (or the age of majority in your state), have the legal capacity to enter into a contract, and are not barred from using the Site under any applicable law. By using the Site, you represent and warrant that you meet these requirements.

Minors between the ages of 13 and 17 may use the Site only with the consent and direct supervision of a parent or legal guardian. Children under 13 may not use the Site at all — see our Privacy Policy.

3. Account Registration (when available)

We may, in the future, allow you to create a customer account on the Site. If you do, you are responsible for:

We reserve the right to suspend or terminate any account that violates these Terms, that we suspect of fraudulent activity, or that has been inactive for an extended period.

4. Products, Pricing, and Availability

4.1 Product descriptions. We try to describe our products as accurately as possible, including ingredients, sizes, and intended use. Hair texture, density, porosity, and individual reactions vary widely, and we cannot guarantee a specific result for any particular person. If you have a known allergy to any ingredient listed on a product page, do not use that product. When in doubt, perform a patch test before full use.

4.2 Pricing. All prices are in U.S. Dollars (USD) and are subject to change without notice. We make every effort to list prices accurately, but if a typographical or system error results in a price that is significantly lower than the intended retail price, we reserve the right to cancel any order placed at that price and issue a full refund.

4.3 Promotional codes. Discount codes (such as MAGICTEN) are valid for the use described at the time of issuance. Unless otherwise stated:

4.4 Availability. Listing a product on the Site is not a guarantee that the product is in stock. If we cannot fulfill any portion of your order due to stock issues, we will contact you and either ship the available portion and refund the rest, or cancel the order entirely and refund all charges.

5. Orders, Payment, and Checkout

5.1 Order acceptance. When you place an order, you are making an offer to buy. We accept your offer only when we send you an order confirmation email and successfully charge your payment method. Until that point, we may cancel your order at our discretion.

5.2 Payment processing. Checkout is hosted by Shopify. By completing checkout, you agree to Shopify's terms in addition to ours. Magic Coils does not receive or store your full payment card number, CVV, or bank account information. We rely on Shopify's PCI-DSS-compliant infrastructure to handle that data securely. See our Privacy Policy for details.

5.3 Sales tax. Sales tax will be calculated and collected at checkout where required by applicable state law. The tax shown at checkout is your final tax obligation for that order.

5.4 Free shipping threshold. Orders over $75 (subtotal, before tax) ship free within the contiguous United States. Below that threshold, standard shipping rates apply and are calculated at checkout.

5.5 Shipping. We ship within 1–3 business days of order confirmation. Transit times vary by destination and carrier (USPS, UPS, FedEx). We are not responsible for carrier delays once a package leaves our fulfillment facility. We do not currently ship internationally.

5.6 Risk of loss. Title and risk of loss pass to you when your order is delivered to the shipping carrier. If a package is lost in transit, contact us at info@magiccoils.net and we will work with the carrier to file a claim. If a package is marked "delivered" but you did not receive it, contact the carrier first — most carriers require lost-package claims to come from the recipient.

6. Returns and Refunds

6.1 Eligibility. We accept returns of unopened, unused products within 14 days of the delivery date for a full refund, less original shipping costs. Opened or used products are not eligible for return for hygiene reasons.

6.2 How to start a return. Email info@magiccoils.net with your order number and the reason for return. We will reply within 2 business days with a return authorization and shipping instructions. Returns sent without prior authorization will not be processed.

6.3 Return shipping. Unless the return is due to our error (wrong product shipped, defective product), the customer is responsible for return shipping costs. We recommend a trackable shipping method — we are not responsible for returns lost in transit.

6.4 Refunds. Once we receive and inspect the returned product, we will issue a refund to the original payment method within 5–10 business days. The time it takes for the refund to appear on your statement depends on your bank or card issuer.

6.5 Damaged or defective products. If your order arrives damaged or defective, email info@magiccoils.net within 7 days of delivery with photos of the damage and your order number. We will replace the product at no cost or issue a full refund, at our discretion.

7. Intellectual Property

7.1 Our content. The Site and all of its content — including but not limited to text, photos, video, graphics, logos, the "Magic Coils" name and crown imagery, "Crowned in Magic" tagline, product names, packaging design, and software — are owned by Hair For You LLC or our licensors and are protected by U.S. and international copyright, trademark, and other intellectual property laws.

7.2 Limited license to you. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial use. You may not:

7.3 Feedback. If you send us suggestions, ideas, or feedback about our products or the Site, you grant us a perpetual, royalty-free, irrevocable license to use that feedback for any purpose without compensation or attribution.

8. User-Generated Content (UGC)

8.1 Posting and tagging. If you tag us on social media using #crownedinmagic, #magiccoils, @magiccoilsofficial, or any related hashtag or handle, or if you submit a photo, video, review, or testimonial via our /share-your-crown page, you grant Hair For You LLC and Magic Coils a perpetual, worldwide, royalty-free, non-exclusive license to use, reproduce, display, distribute, adapt, and create derivative works of your content for marketing, promotional, and commercial purposes, including but not limited to our website, social media accounts, paid ads, packaging, and retail materials.

8.2 You confirm that. When you submit UGC, you confirm that:

8.3 We may. Use, edit, crop, recolor, add brand elements (logo, MAGICTEN code, hashtags), and combine your UGC with other content. We will give attribution where reasonable (typically @-mention on social posts), but we are not required to.

8.4 Removal. If you want us to stop using a specific piece of your UGC, email info@magiccoils.net with the link or screenshot. We will remove it from our active marketing within 30 days, though we cannot guarantee removal from ads already in circulation, retailer materials, or archived content.

9. Prohibited Conduct

When using the Site, you agree not to:

10. Reviews and Submissions

If we offer a product review feature, we reserve the right (but not the obligation) to monitor, edit, or remove reviews that violate these Terms, contain false claims, include profanity or personal attacks, or are submitted in exchange for compensation that is not disclosed. By submitting a review, you agree to the UGC license described in Section 8.

11. Unauthorized Resale

Magic Coils products are sold exclusively through magiccoils.net and authorized retail and salon partners. We do not authorize sale of our products on Amazon, eBay, Facebook Marketplace, or any other third-party marketplace unless specifically agreed in writing with that reseller. We make no warranty for products purchased through unauthorized channels — those products may be counterfeit, expired, or improperly stored. To report unauthorized resale, email info@magiccoils.net.

12. Disclaimers

THE SITE AND ALL PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that any specific product will achieve any particular cosmetic result. Hair care is individual, and reactions to ingredients vary. If you experience an adverse reaction, stop using the product and consult a healthcare professional.

Nothing in our Site or marketing materials constitutes medical advice. Magic Coils products are cosmetic products, not drugs. If you have a scalp condition, hair loss, or any other medical concern, see a dermatologist or trichologist.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HAIR FOR YOU LLC, MAGIC COILS, AND OUR OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR OUR PRODUCTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).

Some states do not allow the exclusion of certain damages, so the limitations above may not apply to you in full.

14. Indemnification

You agree to indemnify, defend, and hold harmless Hair For You LLC, Magic Coils, and our officers, directors, employees, contractors, agents, and affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to:

15. Governing Law and Dispute Resolution

15.1 Governing law. These Terms and any dispute arising out of or related to them or your use of the Site or our products will be governed by the laws of the State of South Carolina, without regard to its conflict-of-laws principles.

15.2 Binding arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or our products (a "Dispute") will be resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules, except as set forth below. Arbitration will be conducted in Columbia, South Carolina (or via telephone/video at the arbitrator's discretion) by a single arbitrator. The arbitrator's decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction.

15.3 Class-action waiver. YOU AND MAGIC COILS AGREE THAT ANY DISPUTE WILL BE BROUGHT INDIVIDUALLY AND NOT AS PART OF A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

15.4 Exceptions. Either party may seek injunctive relief in court for intellectual property infringement, breach of confidentiality, or other claims where monetary damages would not be sufficient. Either party may also bring a claim in small-claims court if the claim qualifies for that court's jurisdiction.

15.5 Opt-out. You may opt out of the arbitration provisions in this Section 15 by sending a written notice to info@magiccoils.net within 30 days of first agreeing to these Terms. Your notice must include your name, address, the date you first used the Site, and a clear statement that you wish to opt out of arbitration. If you opt out, Section 15.1 (governing law) still applies, and disputes will be heard in the state or federal courts located in Richland County, South Carolina.

16. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including for violation of these Terms. Upon termination, any orders you have already placed will still be fulfilled (or refunded) according to these Terms, but you will lose access to the Site. Sections of these Terms that by their nature should survive termination (including intellectual property, indemnification, disclaimers, limitation of liability, and dispute resolution) will continue to apply.

17. Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date at the top of this page will reflect when changes were made. If we make material changes, we will notify you by email (if we have your email address) or by a prominent notice on the Site at least 14 days before the changes take effect. Continued use of the Site after the changes take effect constitutes acceptance of the updated Terms.

18. Miscellaneous

Entire agreement. These Terms, together with our Privacy Policy and any order confirmations you receive, are the entire agreement between you and Magic Coils regarding the Site and your purchases. They supersede any prior agreements or understandings.

Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

No waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to enforce it later.

Assignment. You may not assign these Terms or your rights under them without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of business assets.

Force majeure. We are not responsible for any failure or delay in performance due to causes beyond our reasonable control, including natural disasters, war, civil unrest, government actions, labor disputes, supply chain disruptions, internet outages, or carrier delays.

Headings. The headings in these Terms are for convenience only and do not affect their interpretation.
